Delhi Press has filed a trademark infringement suit against BCCI for naming an IPL robotic dog 'Champak', alleging misuse of its popular children's magazine title.
In the Delhi High Court, Patra Prakashan, the publisher of the kids' magazine Champak, has filed a complaint against the BCCI over the title of a robotic dog featured during the IPL.
According to the publisher, the BCCI's use of the term "Champak" for a robotic dog is blatantly against their protected trademark. In this case, a notice has been issued by Justice Saurabh Banerjee. The case will now be taken up again on July 9, 2004.
While claiming that a BCCI product with the title of Champak magazine is a clear violation of the registered trademark of the publisher, Amit Gupta, an advocate for Delhi Press, said that this magazine is a household name amongst children.
The lawyer was then asked by the court to clarify how unfair advantage and commercial exploitation may be alleged in the case. Despite the fact that the publisher is the mark's authorized owner, Gupta claims that the cricket organization is using the trademark without authorization.
His publication is recognized for its animal characters. Give them the impression that the product is special, but the use is harmful. That's dilution, he said. However, the Court pointed out that there were no charges of unfair benefit in the pleadings. Gupta insisted that the marketing and promotion of the product by themselves could prove commercial exploitation.
Responding on behalf of the BCCI, J Sai Deepak, Senior Advocate stated that the flower's name is Champak. He went on, instead of the magazine, the robotic dog is connected to a character in a television show, referring to the television program Taarak Mehta ka Ooltah Chashma.
