Supreme Court Supports Trucker in CBD Mislabeling Case

Supreme Court Backs Trucker in Landmark CBD Label Case

After claiming he was fired for mislabeling CBD with THC, a truck driver wins a Supreme Court decision for treble damages under RICO.

On Wednesday, the Supreme Court ruled in favour of a truck driver who claims he was dismissed because a CBD hemp product he was using was misrepresented as being free of the active element in marijuana. The man is suing for treble damages.

The trucker's request for threefold damages under anti-mob legislation is approved by the 5-4 ruling. It doesn't resolve his underlying allegations that he was fired because of the product's THC level.

Following a severe injury, Douglas Horn stated that he wanted to alleviate his persistent back and shoulder discomfort. Because the product was touted as being free of THC, the compound that gives marijuana its high, he decided to buy it. A popular nutritional supplement, CBD is a typically legal hemp component.

However, Horn said that lab tests conducted after he was dismissed for failing a standard drug test proved the product did contain THC.

In a complaint brought under the Racketeer Influenced & Corrupt Organizations Act, or RICO, Horn sought triple damages against Medical Marijuana Inc. in Vista, California.

The company retaliated by rejecting Horn's account and claiming that he was not entitled to further damages since he was claiming personal harm rather than commercial loss.

Horn claims he has been financially destroyed and that his dismissal was due to business harm. An appeals court granted Horn's claim.
